The Renter represents warrants and agrees that: -The Renter will use reasonable care to prevent damage to Premises and will indemnify us and our agents from any damages and/or losses arising out of personal injuries or Premises damage resulting from any act of negligence by The Renter, or parties and/or their attendees in connection with use of Premises by The Renter. -The Renter assumes all responsibility for any damage to artwork and/or the Akin space, its contents and any associated visitors or guests at the Premises. -The Renter shall not allow smoking or vaping within the space. -The Renter shall not remove the key from the gallery's lockbox or provide access codes to anyone else during the duration of the rental period. -The Renter shall not assign or sub-let or allow any other person to occupy the rented premises without prior written permission from Akin. -The Renter shall comply with all building, zoning and health codes and other applicable laws for the said premises. -The Renter shall not conduct a business deemed extra hazardous, nuisance or requiring an increase to insurance premiums. -The Renter warrants the rented Premises shall be used only for the proposed Event. -The Renter will ensure that no one, including employees, enters any other area/floor of the building other than the designated area. (unless permitted). -The Renter hereby agrees to co-operate with Akin in connection with limiting the access, of persons not connected with the Event, to the Premises for the Term of this Agreement. The Renter agrees to remove all work by the Deinstallation Date and return the space to its previous condition, including completion of the following steps: -Removing all garbage from the premises; -Returning all furniture or equipment belonging to the gallery to its place in storage; -Leaving floors of gallery in swept and mopped condition; -Filling any holes in gallery walls caused during exhibition; and -Informing Akin of any additional work needing to be done to gallery to return it to its original condition, such as painting of the walls, or repair of any unforeseen issues caused during rental. As per Toronto noise bylaws, there shall be no playing of music past 11pm, and events may run no later than 12:00am midnight. Event Catering: The Renter agrees that any food served during exhibition is solely its responsibility to provide for the Event, and dispose of waste after event. The Renter agrees that any alcohol served during the Event is solely their responsibility to provide and serve according to the provincial laws, and dispose of waste after event. If alcohol is being served, the following must be provided by the renter [ONE WEEK PRIOR] to the Exhibition Date: (i) Special Occasion Permit; (ii) Bartender with SmartServe Certification; (iii) Bar setup and any required items.
